A. If a minimum fee of 1% was charged by the probate attorney, which is extremely unlikely, then the costs to your heirs would be a minimum of $1,500 PLUS the invasion of privacy by the exposure of all of your assets, your indebtedness, potential family disagreements, etc., all of which appear in the probate proceedings. In addition, in most instances the heirs receive nothing until the estate is settled after 18 - 24 months and an Order for closure is issued by the Probate Judge. A properly drafted Living Trust tailored to your particular needs and personal, family and financial situation can usually be obtained for $1,350 to $3,000, an amount which is usually substantially less than the time-consuming costs of probate.
